Spain : Mandatory HIV testing as a weapon on the borderlands
HIV tests have become a weapon in the broad arsenal used to enforce immigration controls in Europe. Although most countries do not have official policies of mandatory or forced testing, it should be clear that, at best, HIV testing of refugees and asylum seekers happens in conditions where informed consent - a precondition for any HIV test - is clearly not possible. New medical insurance locks out undocumented
"Overall," says lawyer Florian Hübner of the Groupe Sida Genève, "Switzerland’s new medical insurance law, known as LAMAL, improves the situation of people living with HIV." Dignity for Mister D, Papers for Ali B.
On 2 May, Mister D won his deportation appeal to the European Court of Human Rights. Mister D, a 37-year-old man from the Caribbean island of St Kitts, arrived in Great Britain in January 1993. Customs claim to have found him carrying a substantial amount of cocaine. Four months later, he pleaded guilty and was sentenced on 10 May 1993 to six years’ imprisonment. French report recommends mandatory HIV testing for pregnant women
A new report by the French Academy of Medicine, published on 7 May 1997, recommends that HIV antibody testing, which is currently "proposed" to pregnant women, should become "mandatory." The report’s author, Profesor Roger Henrion, a gynecologist-obstetrician, believes that making testing mandatory will allow all pregnant women, as well as their future children, to benefit from the progress in AIDS therapies and in science’s understanding of the virus.
